In a landmark judgment, the Supreme Court of India on August 5, 2025, ruled that educational buildings can no longer be exempted from obtaining environmental clearances under existing construction laws.

This decision marks a major shift in how schools, colleges, and universities are built, with a renewed emphasis on sustainable development and compliance with Environmental Impact Assessments (EIA).

The court reviewed earlier notifications by the Ministry of Environment, Forest and Climate Change (MoEFCC), which excluded educational institutions from mandatory green clearance norms under EIA Notification 2006.

A public interest litigation (PIL) was filed questioning the rationale behind excluding large-scale educational infrastructure from environmental oversight, particularly in urban areas with high ecological sensitivity.

A three-judge bench led by Justice B.R. Gavai ruled that such exemptions were “arbitrary and unjustified”, especially when educational buildings contribute significantly to urban congestion, pollution, and groundwater depletion.
